Introduction

These Terms and Conditions (“Terms”) are a legally binding agreement between you ("you", "user", "student", "tutor", or “parent”) and BrainWave ("Company", "we", "us", or "our") concerning your access to and use of our website [www.brainwave.com] and associated services (collectively, the “Site”).

By using the Site or our services, you confirm that you have read, understood, and agreed to be bound by these Terms. If you do not agree, please discontinue use immediately.

Acceptance of Terms

By accessing or registering on the Site, you accept and agree to abide by all conditions outlined in these Terms. Continued use of the Site constitutes acceptance of any future changes we may make. We may update these Terms at any time without prior notice. It is your responsibility to check them periodically.

Eligibility and User Responsibility

Users under the age of 18 must have parental or guardian consent and supervision to access the Site. You agree to provide accurate, complete, and updated information during registration and usage. You also agree not to use the Site for illegal or unauthorized purposes.

If we determine that you have provided inaccurate or misleading information, or have violated any part of these Terms, we reserve the right to suspend or terminate your account.

Intellectual Property Rights

All content on the Site—including text, images, software, logos, code, and media—is the exclusive property of BrainWave or its licensors and is protected by copyright and trademark laws. You may access and use the Site’s content only for personal, non-commercial purposes. No part of the Site may be copied, republished, or reused without our written permission.

Account Creation and Security

You may be required to register for an account. You are responsible for maintaining the confidentiality of your login credentials. We reserve the right to refuse, reclaim, or modify usernames that are offensive or inappropriate.

Use of Services

Our platform provides online and offline academic classes delivered by qualified tutors. Classes must be conducted professionally and punctually. Tutors must inform students and BrainWave at least two hours in advance in case of unavoidable absences and must reschedule the class accordingly.

Tutor Guidelines and Conduct

Tutors must not share or request personal contact information from students or parents. Communication must happen strictly within the platform. Tutors may not accept direct payments from students or parents. All classes must be conducted through BrainWave’s platform unless authorized otherwise. Violations of these guidelines may result in payment deductions, account suspension, or permanent termination.

Tutors are also expected to log in at least five minutes before a session, keep their cameras on during the class, evaluate students regularly, and share progress reports with parents. If a class fails due to technical issues on BrainWave’s platform, the tutor must notify our support team and reschedule the class.

Session Delivery and Payment Policies

If a tutor is unable to complete the full number of booked sessions, they must inform BrainWave. Failure to communicate this or respond to follow-up attempts may result in forfeiture of the tutor’s payment. If the tutor has completed at least 60% of sessions and notifies us of their inability to complete the remainder, they will be paid proportionally.

Payments to tutors are processed within 5–7 business days of receiving a valid payment request. Students are expected to renew sessions only after all previously booked sessions are completed.

Secure Payments and Refunds

We offer secure payment options including UPI, debit cards, credit cards, and net banking. BrainWave does not store card or bank details. We never ask users for such sensitive data via SMS, email, or phone calls.

In case of tutor absence, students are entitled to a credit refund for the missed session. Refunds will be added to the student’s BrainWave wallet for future use.

Prohibited Activities

• Access or use the Site for any unlawful purpose
• Share contact information or bypass the platform for direct transactions
• Misrepresent themselves or impersonate other users
• Reproduce or misuse any proprietary content from the Site
• Conduct classes on third-party platforms without BrainWave’s consent

Third-Party Platforms and Links

If you access BrainWave via a third-party link or platform, the use of your data will be subject to the terms and privacy policies of that platform. BrainWave is not responsible for the content, policies, or practices of any third-party service.

Service Availability

While we strive to maintain uninterrupted access, we do not guarantee that the Site or Services will be error-free or always available. Scheduled maintenance or unexpected downtime may occur.

Limitation of Liability

BrainWave is not responsible for losses, errors, or disputes resulting from reliance on Site content or interactions between tutors and students. We do not guarantee specific academic outcomes or scores and shall not be liable for any damages resulting from the use or inability to use our platform.

Termination of Access

We reserve the right to terminate or restrict access to the Site and Services for any user who breaches these Terms, misuses the platform, or acts in a way that harms the platform or other users.
